This page contains documents relating to Supreme Court of Victoria Proceeding No 2073 of 2002 (F5476) between Ansett and Westpac Banking Corporation.

Under a Participation Agreement dated 9 April 2001, Westpac agreed to pay Ansett certain amounts for points that Ansett credited to Global Rewards Members for purchases made using a Westpac Global Rewards Visa Card. Ansett commenced this proceeding against Westpac in the Supreme Court of Victoria on 17 September 2002 seeking to recover the sum of $16,454,796.23, which Ansett claimed was owed by Westpac under the Participation Agreement.

Westpac filed a Defence and Counterclaim in the proceeding denying liability for the amounts claimed by Ansett, and counterclaiming against Ansett for damages and restitution in amounts exceeding $20m.

A Court-ordered mediation was held between the parties on 14 April 2003. Shortly afterwards the matter settled on mutually satisfactory terms.

A copy of the pleadings filed by the parties is available below.
